After fighting the addition of a second address to the home located at 6419 Caldwell for 2 years going from the Board of Zoning Adjustments to Civil District Court, and then to the Fourth Circuit in LAKE TERRACE PROPERTY OWNERS ASSOCIATION, INC. VERSUS THE CITY OF NEW ORLEANS, BOARD OF ZONING ADJUSTMENTS AND CELSO ERIC HERNANDEZ. COURT OF APPEAL FOURTH CIRCUIT STATE OF LOUISIANA the court ruled in our favor.
In plain English, they said that:
Our neighborhood is and always has been Single Family
No history of a second family using the dwelling (The homeowner staying in it when she was ill, and the son staying in it, are not second family as they were always the owners)
To qualify as a residence you have to prove you have a kitchen. (2nd address was given based on photographs of SHOWER TILE)
The ruling issued by the court
The battle to protect our neighborhood was lengthy and costly, but it prevented development that was not permitted. It was worthwhile to protect us from a developer who had no plans to reside in our area and disregarded our restrictions. These restrictions, established by the State of Louisiana during the creation of our neighborhood, are what make Lake Terrace the beautiful, spacious, and charming place we all call home.
